These terms cover the transaction coordination service Guaranteed TC provides to a brokerage, and the use of this application. Engaging us, or signing in, means agreeing to them.

What we do

We coordinate residential real estate transactions in California: tracking contract dates, collecting and filing the documents your compliance checklist requires, corresponding with clients, agents and escrow, and keeping the file in order through to closing.

We are not brokers, lawyers, or escrow. We do not give legal advice, do not advise on the terms of a contract, and do not represent any party to a transaction. The broker of record remains responsible for supervision and for compliance with the Department of Real Estate’s requirements.

The guarantee

Your file will be complete, or you do not pay for it. Complete means every document required by the brokerage’s compliance checklist for that property type and side is collected, executed and filed.

When completeness is measured. Not on the closing date. Some documents only exist after a transaction closes, and closeout takes a few days, so there is a buffer between the transaction closing and the file being marked complete. That buffer allows for post-closing document collection and the closeout procedure. The guarantee is assessed at the end of it, against the file as it stands at closeout.

The guarantee requires four things from the brokerage on each file:

  • The fully executed contract and all counters within one business day of acceptance
  • A response to a coordinator request within one business day
  • Requested signatures returned within two business days
  • Deadline-critical information sent through the portal or by email, not by text message

Two misses on a file suspends the guarantee for that file only. It does not affect any other file. We log every request, follow-up and response with a timestamp, and will show you that record rather than argue about it.

The guarantee covers our fee for that file. It is not a warranty of the transaction itself, and it does not cover a deal that fails for reasons outside document completeness.

Fees and payment

  • $400 per closed file, one side. $500 for a double end, meaning one address and both sides.
  • A file that does not close costs nothing.
  • Brokerage onboarding is $99, once.
  • We invoice escrow so the fee is included in the closing statement. Where that does not happen, we invoice the brokerage directly and payment by card or PayPal carries a $20 processing fee. Payment by check or wire does not.

Your documents and your Drive

Transaction documents are created in and remain in the brokerage’s own Google Drive, owned by the brokerage throughout. We request only the permission needed to manage files this application itself creates. You may revoke that access at any time; doing so ends our ability to file documents but does not affect any document already there.

If the engagement ends, you keep everything. There is nothing to export, because it was never held anywhere else.

Confidentiality

Coordinators work across multiple brokerages and see transaction information belonging to each. Everyone with access is bound to treat it as confidential and to use it only to do the work. We do not disclose one brokerage’s information to another.

Ending it

Either of us may end the engagement with written notice. Files already open run to closing under these terms unless we agree otherwise, and fees for files that close are payable as normal.

Liability

Our aggregate liability for any claim arising from a file is limited to the fees paid or payable for that file. We are not liable for indirect or consequential loss. Nothing here limits liability that cannot lawfully be limited.
